Our Charlotte, North Carolina Car Accident Law Firm Wants to Remind Everyone to Drive Safely and Soberly Over the Labor Day Weekend

With 1,422 North Carolina traffic crashes resulting in 12 deaths and 903 injuries over the last Labor Day weekend, it is no wonder that State Highway Patrol officers will be on alert for drunk drivers and speeding motorists in an effort to prevent the number of auto crashes that occur this year. Running through September 6, the “Booze It and Lose It” campaign is in effect.

Additional patrols and checkpoints are set up throughout the state. Last year, officers gave out over 105,370 criminal and traffic citations during the Labor Day campaign.

According to findings from a National Highway Traffic Safety Administration 2008 study that surveyed 6,999 people, even though four out of five people think that driving drunk is dangerous, one in five say that they have driven within two hours of having had an alcoholic drink. 1 in 12 drivers admitted that within a 12-month period they had driven drunk. NHTSA Administrator David Strickland notes that more needs to be done to bridge the gap between people knowing that driving drunk is dangerous and acting in a manner more consistent with that awareness.

More Findings from the NHTSA Survey:
•	About 17.2 million Americans have driven even when they thought their blood-alcohol level was higher than the legal driving limit.
•	8% have gotten into a car operated by someone that they thought was too inebriated to drive.
•	40% said they thought they could drive after three alcoholic beverages.
•	11% said they thought they could drive after five drinks.

The US Department of Transportation reports that drunk drivers are involved in 1/3rd of deadly car crashes that occur in this country. In North Carolina last year, there were 11,304 alcohol-related traffic crashes resulting in 8,791 injuries and 394 deaths.

Governors Highway Safety Association chairman Vernon Betkey is quoted in USA Today as saying that the number of motor vehicle accident fatalities could be lowered by 50% if people stopped driving drunk and everyone wore seatbelts.

Our Charlotte, North Carolina car accident law firm would like to remind you to wear your seatbelt, obey the speed limit, and refrain from driving while drunk or distracted not just over the Labor Day weekend but during every day of the year.

North Carolina Highway Patrol Looks to Prevent Mecklenburg County Truck Crashes with Operation Road Watch

In an effort to prevent motor carrier safety violations on state highways, the North Carolina Highway Patrol will be conducting Operation Road Watch on I-77 in Mecklenburg County for the next two days. Highway troopers are hoping to limit the number of semi-truck crashes along the corridor. Not only are they checking 18-wheeler truckers for aggressive truck drivers, but also they are looking for hazmat violations and unsecured loads.

Tractor-trailer violations can prove dangerous not just for the trucker but also for others on the road. In 2009, North Carolina state troopers investigated 5,577 of the 8,641 North Carolina motor carrier vehicle crashes that occurred. 98 fatalities and 1,839 injuries resulted from these collisions.

Police believe their efforts through Operation Road Watch will decrease the number of deadly North Carolina semi-truck crashes while also limiting the traffic congestion can occur when a large truck accident happens. Drivers that operate their vehicles aggressively when around tractor-trailers, speeders, aggressive drivers, and tailgaters will also receive tickets. This is the first campaign to concentrate only on commercial vehicle violations. Operation Road Watch will be going to other counties later in the year.

Our Charlotte, North Carolina truck accident law firm represent clients in North Carolina and South Carolina. We cannot stress enough how important it is to explore your legal options as soon as possible.

Just last week, 35-year-old Joshua Charles Woodrow died when the tanker he was driving was involved in a South Carolina tanker truck accident on I-77 and exploded. The truck which is owned by MTM Transportation and was hauling 8,500 gallons of gasoline, rolled onto its side, struck the sedan, and burst into flames.

Charlotte Pedestrian Accident Claims Life of Nurse Standing Outside North Carolina Assisted Living Facility

Susan Karabulut, a 33-year-old nurse who worked at the White Oak Manor retirement nursing home, was killed in a Charlotte, North Carolina pedestrian accident on Sunday. Karabulut was standing outside the assisted living facility when a car that drove onto the sidewalk where she was standing and fatally struck her. Another woman, 47-year-old Lisa McTe, suffered life-threatening injuries.

The driver of the car that struck her, 21-year-old Leah Anne Walton, has been charged with reckless driving, driving with no liability insurance, involuntary manslaughter, drug and marijuana paraphernalia possession, and driving with a revoked vehicle registration. Walton told police that she had briefly taken her eyes off the road to reach into her bag for a cigarette.

According to investigators, Walton crossed the double yellow line and drove across the lanes of opposing traffic before striking the two women. Karabulut was pronounced dead at the Charlotte, North Carolina pedestrian accident site.

Distracted Driving
It is never advisable to take your eyes off the road while driving. Acts that are harmless enough when done while not driving, such as looking at the radio while changing the station, reading directions on a map, choosing a new playlist on an iPod, or rifling through a makeup bag to find that right shade of lipstick can turn dangerous when these activities distract a motorist long enough that he/she ends up causing a North Carolina car crash resulting injuries or death.

It can take mere seconds for a catastrophic Charlotte, North Carolina motor vehicle crash to occur. The driver likely never intended to hurt anyone, but that doesn’t mean that he or she won’t be held liable in civil court. There also may be criminal charges.

Union County, North Carolina Car Accident Involving Grain Truck Kills Two Incoming Wingate University Students

A Union County, North Carolina truck accident has claimed the lives of Fayetteville teen Mishawn Miller and Greensboro teen Arielle Parker, both age 18.The two incoming Wingate University freshmen were heading to a ropes challenge course on Saturday morning when, according to police, Miller failed to halt at a stop sign on Old Pageland Monroe Road. His vehicle was hit on the driver’s side by a grain truck.

Miller and Parker, who was sitting in the backseat, were killed instantly. Seriously injured in the North Carolina car accident was 18-year-old Charlotte resident Marcelle Louba, who was sitting behind Miller. 19-year-old Kendric Reid, who was sitting in the front passenger seat, sustained minor injuries. The teenagers were traveling in a caravan of other students who were taking part in an academic enrichment program for students about to begin their freshman year at the university.

The grain truck driver, 52-year-old Elberbe resident Carlon Watkins, also sustained minor injuries. The grain truck that he was driving had a similar dimension and weight as a dump truck.

According to neighbors in the area, although a flashing red light has been installed at the intersection where the Union County, North Carolina car accident happened, more needs to be done to prevent future traffic accidents. Visibility can be poor there, which can make it hard for motorists to see approaching vehicles. Some have even called for the installation of a traffic light. Although the Department of Transportation received a petition for a light that was signed by hundreds, it denied the request saying that not enough traffic traveled through the intersection.

There are steps that you can take to protecting your right to financial recovery for injuries sustained during a Wingate car accident.

Teen Driver Accused of Causing Charlotte, North Carolina Pedestrian Accident that Injured Three Booked on DWI Charges Again

Nearly two weeks after striking three people during a Charlotte, North Carolina pedestrian accident in the Elizabeth neighborhood, 19-year-old driver Kirstie Pienta has been booked for DWI. This is her second driving while intoxicated charge. Pienta was previously charged for speeding, DWI, following too closely driving after consuming under 21, and civil revocation of license. She now is also charged with driving and consuming alcohol under the age of 21 and felony serious injury by vehicle.

The Charlotte, North Carolina car crash occurred on August 1 at around 2am on 7th Street. Police say that the teen driver struck a number of pedestrians, even dragging one of them, Danielle Moore, almost 100 feet. They don’t believe that Pienta stepped on the brakes.

According to witnesses, the teen motorist was driving at a speed of at least 45 mph in a 35 mph zone. They also say that she was drinking and her speech was slurred less than half an hour before the Charlotte pedestrian accident.

One of the pedestrians that she allegedly struck, Michael Hayes, injured his leg. He says that he will have to undergo follow-up surgery. Also struck was Damion Jenkins. Moore, who sustained compound fractures to her leg, was taken to the hospital in fair condition.

Pienta, who was transported to the hospital in serious condition for her Charlotte, North Carolina car accident injuries, was taken to jail after she was discharged.

Charlotte, North Carolina Car Accidents
Our Charlotte, North Carolina car accident law firm is determined to help teenagers become aware of the dangers that can come with driving drunk. Every year, the Law Offices of Michael A. DeMayo awards college scholarships to a number of high school students who have come up with inspiring and innovative ways to discourage drunk driving among their peers.

Youth and inexperience already increase the risk that a young motorist may become involved in a traffic crash when he/she is sober—let alone when driving under the influence of alcohol or drugs. When injuries or death result, a young driver may have to face not just criminal charges but also a civil claim for Charlotte, North Carolina wrongful death or personal injury.

Disabled Plymouth Cyclist Killed in North Carolina Truck Accident

Albert Arnott is dead. The Plymouth local, who couldn’t walk but was able to ride a bicycle across the US, sustained fatal injuries when he was struck by a pickup truck while riding his recumbent machine on US Highway 61. The North Carolina truck accident happened on July 31.

Arnott, 60, became disabled during a work accident nearly two decades ago when he fell from a tree while landscaping. He sustained a traumatic brain injury and lost his ability to walk. However, that didn’t stop him from training himself to walking on crutches and cycle.

The driver of the pickup truck, 30-year-old Justin Mark Keaton, says he did not see Arnott. This week, Keaton was charged with misdemeanor death by motor vehicle.

North Carolina Pedalcyclist Accidents
It is so important for drivers to remember that they share the road with pedalcyclists. North Carolina bicycle accidents do claim lives and often, the motorist that struck the rider can be charged with a crime even though he/she never intended to hurt anyone. He/she can also become the defendant of a North Carolina personal injury case.

In another recent North Carolina bicycle accident, Linda Sink is charged with misdemeanor death by motor vehicle and failure to reduce speed because she accidentally struck two cyclists with her car last month in Stokes County. Police say that she wasn’t paying attention—an allegation that she disputes.

Killed in this North Carolina traffic crash was 62-year-old Donald Sunday. The other rider, 62-year-old Barry Leonard, suffered a broken pelvis.

How drivers can avoid hitting bicyclists:

•	Obey traffic laws
•	Don’t speed
•	Don’t drive drunk
•	Don’t talk text while driving
•	Watch out for cyclists
•	Be carefully when passing a bicyclist

North Carolina Drunk Driving Accidents Continue to Claim Lives

Our Charlotte, North Carolina car accident lawyers continue to take proactive steps to remind motorists of the dangers of drunken driving. Operating a vehicle under the influence is a crime and can cause cause serious injuries and claim lives.

Just last Sunday, 17-year-old Laura Fortenberry died after the car she was riding collided head-on with the auto driven by Bessemer City resident Howard Pasour on Dallas-Cherryville Highway in Gaston County. The two people riding in the car with the Lowell teen, 17-year-old Evan Griffith and 19-year-old Victoria Elizabeth Iffergan, were also taken to a Charlotte, North Carolina hospital.

Police say that Pasour, 28, drove his vehicle across the center line and that there were open alcohol containers in his Jeep Cherokee. He has three prior DWI convictions that in the past resulted in the revocation of his driver’s license and the requirement that he use an ankle bracelet. Pasour is charged with assault with a deadly weapon, second-degree murder, aggravated assault, aggravated felony death by motor vehicle, and habitual DWI.

In another North Carolina drunk driving accident earlier this month, an 18-year-old car crash victim was flown to Carolinas Medical Center after the car she was in went off the road and struck a tree. The driver of the vehicle, 18-year-old Stanley teen Amanda Joy Ross, faces a driving while impaired charge. She reportedly had a blood-alcohol content of 0.15.

Deadly Jamestown, North Carolina Car Crash: State Attorney General’s Office Says It Won’t Release Investigation Report

Two months after a police pursuit ended in a Jamestown car accident that claimed the lives of 55-year-old Sandra Allmond and her 11-year-old granddaughter Taylor Strange and injured Elijah Allmond and Steven Strange, the North Carolina Attorney General's Office’s saying that it won’t release the investigation report that it commissioned. The deadly North Carolina auto accident happened as NC Highway Patrol Officer J.D. Goodnight was pursuing a vehicle moving at 80 mph in a 55 mph zone.

Goodnight’s vehicle was reportedly moving at a speed above the speed limit, reduced from 120 mph, when he struck the auto carrying the four car accident victims. One witness has stepped forward claiming that the state trooper was not pursuing anyone when the collision happened. He also says that he saw the police officer’s blue lights but did not hear a siren. Investigators have said that Allmond did not yield the right of way.

However, the Attorney General's Office is saying that since it is its job to represent the state, and North Carolina wrongful death and personal injury lawsuits will likely be filed, sharing the information would “prohibit the state’s ability to defend the state” from such complaints.

At least three of the victim’s families have already hired North Carolina car accident lawyers. Since the deadly Jamestown auto collision, North Carolina's Highway Patrol has modified its rules for pursuing criminal suspects. Under the new policy, a trooper is not allowed to join a police chase unless he/she if formally asked to help by a local police agency’s emergency communications center.

Police officers must abide by the speed limit and obey traffic signs. In the event that they are embroiled in a police pursuit that requires that they disregard traffic laws, then it is important that they warn other motorists and pedestrians while exercising caution that they not become involved in any type of North Carolina motor vehicle collision. Stopping suspects and rushing to the scene of a crime are not good enough reasons for causing accidental injury or death to others.

Charlotte, North Carolina Tractor-Trailer Crash on Interstate 85 Injures Three

A multi-vehicle crash involving two tractor-trailers that took place at around 11 pm last night has left three people with injuries. The Charlotte, North Carolina semi-truck crash took place on Interstate 85.

According to police, one tractor-trailer crashed into another auto as the trucker attempted to change lanes. The second auto was shoved off the road where it struck a guardrail before reentering traffic and getting hit by another semi-truck. Meantime, the large truck that started the chain reaction hit another vehicle, which also struck a guardrail before careening back into traffic, and then drove off the ramp and jackknifed into a ditch.

One person sustained serious injuries. Two other truck crash victims suffered minor injuries.

2 Recent Charlotte, North Carolina Truck Accidents Allegedly Caused by Drunken Drivers

A Belmont man was killed in a Charlotte, North Carolina truck accident on Thursday when his vehicle was pushed in front of a tractor-trailer by another auto. The driver of that vehicle, 28-year-old Demaris Goodson, is charged with driving while intoxicated. Other charges may be filed against him once he gets out of the hospital.

According to Charlotte-Mecklenburg Police, the victim, Maurice McDowell, died at the Charlotte, North Carolina car accident site on Brookshire Boulevard. The driver of the semi-truck was not injured.

Records show that Goodson has committed several traffic violations in the past, including the offenses of speeding and reckless driving. All cases, however, were waived or dismissed.

In another alleged drunk driver-related accident on Thursday, motorist Arthur Bidgood was going the wrong way on I-77 when he was involved in a Charlotte, North Carolina automobile accident with a paint truck and a tractor-trailer. The driver of the pickup truck reportedly jackknifed as it tried to avoid hitting Bidgood’s vehicle and was rear-ended by the semi-truck.

Bidgood is charged with reckless driving, driving while impaired, and driving the wrong way.

Our Charlotte, North Carolina personal injury law firm cannot stress enough how dangerous it is to drive while drunk. Drunk driving accidents are preventable accidents that would not have happened if only the drunken motorist had either decided not to drink or had opted to stay off the road.

We know how hard it is to have to live without your loved one and to cope with the fact that he/she was killed in such a senseless manner. We also know how devastating it can be to be the one left with catastrophic injuries because another driver was drunk.

Robeson County Car Accident Kills Two

A Lumberton man has been charged with two counts of misdemeanor death by vehicle in the Robeson County car accident that killed his passenger and another driver on July 5. The North Carolina motor vehicle collision occurred at a stop sign at the four-way intersection of Rennert Road and McQueen Road.

Heckel, 21, reportedly failed to stop at the stop sign and was driving at a speed of 35 miles per hour when his vehicle was hit by a pickup truck traveling at about 50 mph. The driver of the pickup truck, Fred Nelson Gibbs, was wearing a seatbelt at the time, but it malfunctioned and he was thrown from his vehicle. He died at the crash site from his injuries.

Also killed in the Lumberton car accident was Brittany Graybill from Clayton. The 20-year-old was Heckel’s girlfriend and a passenger in his vehicle. She was later pronounced dead at a Fayetteville hospital.

According to North Carolina Highway Patrol Trooper R.D. Wright, who is investigating the case, it is not clear why Heckel did not yield the right of way. Wright does not believe that speeding, drugs, or alcohol were a factor.

Not only is failure to stop at a stop sign a traffic violation, but it can also lead to serious injuries or deaths. Most motorists responsible for causing traffic crashes never intended to become involved in any type of accident let alone cause North Carolina wrongful death or personal injury.

Victims Recovering from North Carolina Tractor-Trailer Accident Involving Tour Bus

The 12 people that were injured in a July 1 North Carolina truck-bus accident on Interstate 85 close to the Gaston/Mecklenburg County line are recovering from their injuries. The North Carolina bus accident happened when the bus rear-ended a tractor-trailer that was stopped behind another truck, causing a rear-end collision between the two trucks.

Among those who were injured were members of the gospel group The Bowling Family, including Mike and Kelly Bowling and their three children. According to a spokesperson that issued a news release, Mike, who was ejected from the bus during the collision, sustained multiple facial injuries and a fractures skull. He is expected to undergo additional surgeries to treat his North Carolina bus accident injuries. Kelly Bowling broke a foot and her vertebrae and will likely have to use a body brace for several months. She may also have to undergo surgery. Their six-year-old daughter Katelanne broke her collarbone. She had to have plastic surgery to repair a deep facial laceration.

Police have said that a the backlog of trucks attempting to get into a weigh station played a part in the Belmont truck accident. The truck backup reportedly extended from the weigh station, across the river bridge, and into the city limits and that this caused the tour bus driver to suddenly run into the line of trucks without any previous warning.

The weigh station, which was built in 1979, may now be too small to handle the large volume of trucks that need to be checked. According to the North Carolina Highway Patrol, which runs the weigh station, there is a $300,000 camera system that is supposed to warn people in the station when the trucks are backed-up all the way to the highway. However, this is reportedly not an uncommon occurrence. Belmont Police Chief David James says that other North Carolina truck accidents have happened for this same reason. The Highway patrol is looking at possible sites to set up a new weigh station where longer ramps could be set up.

Catawba County Motorcycle Crash on North Carolina Highway 10 Injures Two Motorcycle Riders

Two motorcycle riders sustained serious injuries on Thursday morning when they were thrown from the bike they were riding in a Catawba County motorcycle accident close to the intersection of Highway 10 and Bethany Church. According to witnesses, the motorcycle driver was operating the bike at a speed of over 100 mph when it crashed into a 1989 Mazda pickup truck that had stopped to make a left turn.

Police say that the pickup truck driver never saw the motorcycle. A small hill at the intersection made it hard to see.

The motorcycle’s driver, Bruce Offenbacker Jr. of Catawba, was thrown 97 feet while his girlfriend, Jasmine Shope of Newton, was thrown 154 feet. At the North Carolina motorcycle accident site, Offenbacker complained that he couldn’t feel his legs. He sustained multiple broken bones and fractures. Shope was admitted to the hospital in critical condition.

A mother and son who were riding in the pickup truck were treated at the hospital for minor injuries. The pickup truck driver refused to be transported to the hospital following the Catawba County motorcycle collision.

Common Causes of North Carolina motorcycle crashes:

•	Speeding
•	Distracted driving
•	Poor visibility
•	Road hazards and defects
•	Texting or talking on a cell phone while driving
•	Motorcycle defects
•	Drunk driving

70% of motorcycle accidents involving other vehicles occur at intersections.

Motorcycle riders only have their helmets and safety gear to protect them during a collision. Many motorcycle accidents result in catastrophic injuries for the victims. If you or your loved one got hurt in a North Carolina motorcycle accident that you believe was caused by the other driver, you may have grounds for pursuing a personal injury lawsuit.

Avoid Charlotte, North Carolina Car Accidents By Adhering to NHTSA Advisory on Safe Summer Driving

The National Highway Traffic Safety Administration wants to remind US motorists to drive safely during the summer driving season. Millions of Americans are expected to take to the roads over the next few months. To prevent these excursions or vacations from turning tragic, the NHTSA wants to remind motorists to:

•	Avoid distracted driving, including texting or talking on a cell phone while behind a steering wheel.
•	Stay up-to-date on auto maintenance.
•	Make sure to inspect your tires and ensure that they are properly inflated.
•	Obey the speed limit.
•	Make sure everyone in the car is wearing an appropriate seat belt or child safety seat.
•	Don’t leave children unattended near or in a vehicle.
•	Don’t drive while exhausted or drowsy.
•	Don’t drink and drive.

The NHTSA is reminding parents of teen drivers that there are preventive measures that they can take to prevent their teenagers from becoming involved in a deadly traffic crash this summer. Because many of them have more free time now that school is out, drivers in the 15 to 20 age group are at higher risk of being involved in an auto collision—already the leading cause of teenager deaths. The number of teen drunk driving fatalities are also known to go up during the summer months.

Our Charlotte, North Carolina car accident lawyers are committed to discouraging teens from driving drunk. Every year, we select a number of high school students as winners of the Michael A. DeMayo Scholarship Program. The recipients are selected based on their SAT scores, grades, community involvement, and original presentations that teach other kids about how dangerous it is to drive while under the influence. This year, winners each won a $2,500 college scholarship.

Charlotte Teacher Fatally Struck in Union County, North Carolina Motorcycle Accident

51-year-old Donald James Fumo died on June 6 when he was involved in a deadly Union County, North Carolina motorcycle accident. The Charlotte teacher was fatally injured when his bike was rear-ended by an SUV. The impact of the crash sent his motorcycle into a stopped vehicle, resulting in a motor vehicle crash with two other motor vehicles.

Police are blaming Hardin Forsyth, a Matthews resident, of causing the fatal motorcycle collision. They are accusing him of driver distraction, driver inattention, and failure to reduce speed. Forsyth says that he tried to step on his brakes to avoid hitting the motorcycle, but was unable to do so in enough time to prevent the Union County traffic crash.

Three other people were also injured during the multi-vehicle crash. Police are still investigating the North Carolina motorcycle accident.

In another North Carolina motorcycle accident, 36-year-old Asheville resident Johnnie Nelson Faircloth Jr. died when he was struck by a car on June 11. The alleged driver, 22-year-old Aron Clifford Hallum, left the vehicle he was driving and his two passengers to flee the crash site but later turned himself in. He has been charged with driving with a revoked license and felony hit-and-run. A female passenger who had been riding with Faircloth also was injured, but her injuries did not appear to be life-threatening.

North Carolina Motorcycle Accidents
Motorcyclists have the same rights on the road as to the occupants of motor vehicles, buses, and trucks. Unfortunately, many drivers fail to look out for them, which can result in catastrophic accidents. It is devastating to lose the person you love in a motorcycle crash that was caused by another party’s negligence.
